Terms of Service

1. Acceptance of Terms

By using Vavilon Finance ("Vavilon", "App", "Service"), you confirm that you have read, understood and agree to these Terms of Service ("Terms").

If you do not agree with any provision of these Terms, please do not use the App.

The App is intended for users aged 17 and older in accordance with the App Store age rating. By using the App, you confirm that you meet this requirement.

2. Description of Service

Vavilon Finance is a personal finance app for tracking income, expenses, accounts, loans, assets, payments, budget and financial goals.

The App helps users structure their personal finances, analyze cash flows, track obligations and build financial habits.

Important: Vavilon is not a bank, broker, payment institution, microfinance organization, investment advisor, tax consultant or legal advisor.

  • Limited access to AI features where available in your region

Premium Version

  • Extended access to all App features
  • Arkad AI advisor within established usage limits
  • Advanced analytics, goals, streams, data import and export
  • Additional features as described in the current App Store listing

Trial Period

If a trial period is available for your region or account, its terms are displayed in the App Store or within the App before subscribing. After the trial ends, the subscription may renew automatically unless cancelled through Apple ID settings.

3. Data Storage, iCloud and Family Mode

3.1 Where Financial Data is Stored

Your financial data is stored locally on your device and/or in your personal iCloud account when using sync features.

Vavilon does not store your financial data on its own servers.

Core principle: your financial data stays on your devices and in your iCloud. Vavilon has no direct access to your accounts, transactions, debts, budget or assets.

3.2 iCloud Sync and Apple CloudKit

To sync data between your devices, the App may use Apple iCloud / CloudKit infrastructure.

Sync depends on your Apple ID, iCloud settings, Apple service availability and internet connection.

Vavilon does not control Apple's infrastructure and is not responsible for iCloud / CloudKit unavailability, delays, sync failures or changes.

3.3 Family Mode

Family mode features allow you to voluntarily share access to certain financial data with invited members via Apple's sharing mechanisms.

You independently decide who to grant access to and are responsible for the consequences of such access.

Vavilon does not control the composition of family groups, relationships between members or how invited members use shared information.

3.4 Data Deletion

Deleting the App, disabling iCloud, signing out of Apple ID or changing sync settings may affect data availability. Before deleting the App, we recommend using export features if available.

4. Arkad AI Assistant and AI Features

⚠️ Important: Arkad AI provides information for educational, analytical and informational purposes only. Its responses do not constitute financial, investment, tax, legal or any other professional advice.

4.1 Nature of AI Responses

  • Arkad is not a licensed financial advisor or consultant
  • AI may make mistakes, especially with incomplete, inaccurate or outdated data
  • All financial decisions are made solely by you
  • For important decisions, consult licensed professionals

4.2 Anonymization and Proxy

For AI features to work, the App may generate an anonymized financial context. Before sending a request, personal data and identifiers are removed or generalized on your device.

AI requests are routed through Vavilon's secure proxy service, which is used solely for technical routing of anonymized requests to AI providers.

4.3 AI Providers

Depending on your region and technical availability, requests may be processed by different AI providers.

  • RU · BY Requests may be processed via GigaChat (Sberbank)
  • Other regions Requests may be processed via Claude API (Anthropic) or another available provider

Vavilon may change AI providers, routing or technical processing methods while maintaining the overall purpose of the feature.

4.4 Consent to AI Processing

By using AI features, you agree to the transmission of anonymized context to the relevant AI provider via Vavilon's proxy service.

If you do not wish to use AI processing, do not use Arkad or AI import features.

4.5 AI Feature Limits

AI features may have limits on the number of requests, usage period, plan, region or technical availability. Limits may change to ensure stable Service operation.

5. Subscription and Payment

Premium access is paid through the Apple App Store using StoreKit. Vavilon never receives or stores your bank card, payment system or payment account data.

5.1 Auto-Renewal

Subscriptions auto-renew unless cancelled no later than the deadline set by Apple App Store rules.

Manage your subscription via: Device Settings → Apple ID → Subscriptions → Vavilon.

5.2 Prices and Regions

Actual prices, currency, taxes and available plans are shown in the App Store and may vary by region.

5.3 Refunds

All refund matters are governed by Apple App Store policies. You may request a refund through Apple's mechanisms.

5.4 Lifetime Purchase

Lifetime purchase provides permanent access to Premium features existing at the time of purchase. The developer reserves the right to release separate new products, services or feature extensions under separate terms.

6. Data Import and Export

6.1 Bank Statement Import

The App may support importing bank statements, CSV, Excel, PDF or other formats provided by you.

You are responsible for the accuracy, legality and relevance of imported data.

Vavilon does not guarantee that all bank formats will import without errors, as banks may change file structures, column names, encodings and statement formats.

6.2 Transaction Review

Imported transactions may require manual confirmation, categorization, duplicate review or correction by you.

6.3 Data Export

You may export data in supported formats including CSV, Excel and PDF, if these features are available in your plan and App version.

Exported files are stored and shared by you independently. After export, Vavilon does not control further storage, transfer or security of such files.

7. Prohibited Uses

When using the App, you may not:

  • Use the App for unlawful purposes
  • Use the App for fraud, concealment of illegal income or evasion of obligations
  • Attempt to gain unauthorized access to the proxy service, API, infrastructure or other users' data
  • Reverse engineer, decompile, modify or copy the App's source code
  • Intentionally create excessive load on the AI proxy, servers or App infrastructure
  • Store third-party data without their knowledge or consent where required by law
  • Violate Apple App Store rules, iCloud terms, AI provider terms or applicable law

8. User Responsibility

You are responsible for:

  • The accuracy and completeness of financial data you enter
  • The security of your device, Apple ID, passwords, biometrics and App access
  • Third-party data entered in loan, contact or other records
  • Obtaining third-party consent to store their data where required by law
  • Decisions made based on App data, calculations, projections or AI responses
  • Reviewing imported data and correct categorization of transactions
  • Data safety including use of iCloud, local export and backups
Vavilon helps you track your finances but does not replace your personal responsibility for financial decisions, tax obligations, loan agreements and legal consequences of your actions.

9. Limitation of Liability

The App is provided "as is". The developer does not guarantee uninterrupted operation, absence of errors, accuracy of all calculations, completeness of data or achievement of financial results.

The developer is not liable for:

  • Financial losses incurred based on App data, calculations, projections or AI responses
  • Investment, credit, tax, legal or other decisions made by you
  • Errors resulting from incorrect or incomplete data entered by you
  • Data loss due to App deletion, device failure, iCloud errors, Apple ID issues or your actions
  • AI feature unavailability due to AI provider failures, proxy issues, network problems or regional restrictions
  • Actions or inactions of third parties including Apple, AI providers, banks and internet providers
  • Functionality changes due to iOS, iPadOS, macOS, iCloud, App Store or Apple requirement updates

To the maximum extent permitted by law, the developer's total liability is limited to the amount paid by you for the App in the last 12 months.

10. Intellectual Property

All rights to the App, including source code, design, interfaces, texts, visual materials, the Vavilon name, Vavilon Finance brand, Arkad character, "Wisdom of Babylon" concept and other product elements belong to the developer or are used on a lawful basis.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.

Financial data you enter into the App belongs to you. Vavilon makes no claim of ownership over such data.

11. Termination

You may stop using the App at any time by deleting it from your device.

Deleting the App does not automatically cancel an active subscription. To cancel, use your Apple ID settings.

The developer may restrict access to AI features, the proxy service or certain App capabilities in cases of abuse, violation of these Terms, technical necessity, legal requirements or platform requirements.

12. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan, unless otherwise required by mandatory provisions of the laws of your country.

Disputes shall be resolved by negotiation where possible. If a dispute cannot be resolved by negotiation, it shall be resolved in accordance with applicable law.

Users from certain regions may have additional mandatory rights, including GDPR, CCPA, Federal Law No. 152-FZ or other local requirements where applicable.

13. Changes to Terms

The developer may periodically update these Terms. Users may be notified of material changes through an App update, the website or other available channels.

Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
